Agreement to Terms

By accessing or using StewardKit ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

Description of Service

StewardKit is a donation management platform that enables faith-based organizations to accept online donations. The Service includes web-based tools for donation processing, donor management, and tax receipt generation.

User Accounts

For Organizations

  • You must provide accurate and complete information when creating an account
  • You are responsible for maintaining the security of your account credentials
  • You must be authorized to act on behalf of your organization
  • You are responsible for all activity that occurs under your account

For Donors

  • You may make donations without creating an account, though an account provides additional features
  • You must provide accurate contact and payment information
  • You are responsible for any donations made using your payment methods

Donations and Payments

  • All donations are processed securely by our PCI-compliant payment processing partners
  • Donations are made directly to the organization you select
  • StewardKit does not hold donated funds; they are deposited directly to the organization's own bank account through its merchant account
  • Refund requests should be directed to the receiving organization
  • Tax receipts are generated by the receiving organization; consult a tax professional regarding deductibility

SMS Terms

If you provide your phone number and use our express checkout feature, you consent to receive SMS messages from StewardKit for the following purpose:

  • Program Name: StewardKit Express Checkout Verification
  • Message Content: One-time verification codes to authenticate your identity when accessing saved payment methods
  • Message Frequency: You will receive one SMS message each time you initiate express checkout and need to verify your identity. This is not a recurring message program.
  • Message and Data Rates: Standard message and data rates may apply depending on your mobile carrier

SMS Opt-Out

To stop receiving SMS messages, you can reply STOP to any message. After opting out, you will not be able to use the express checkout feature with saved payment methods, but you can still make donations by entering your payment information manually.

Supported Carriers

SMS messages are supported on most major US carriers. Carriers are not liable for delayed or undelivered messages.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Interfere with or disrupt the Service or its servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service to transmit spam, malware, or other harmful content
  • Impersonate any person or entity or misrepresent your affiliation
  • Use the Service in any way that could damage our reputation or goodwill

Email Sending and Fair Use

Email sending included with a subscription is not subject to a preset monthly allowance. It is subject to this section and to reasonable controls we apply to protect the security, availability, deliverability, sender reputation, and lawful operation of the Service and our email delivery providers. "Unlimited" does not mean unrestricted, guaranteed, or immune from review, rate limits, suspension, or other enforcement under these Terms. We do not guarantee that any message will be delivered.

Your responsibilities

  • You represent and warrant that, for each recipient, you have and will maintain a lawful basis and all notices, permissions, consents, or other authority required by applicable law to process that person's information and send them the message in question. You will keep reasonable records sufficient to substantiate that authority if we ask for them.
  • You must not send to any list or address you purchased, rented, leased, scraped, harvested, appended, collected automatically, acquired from a list broker, or obtained from a third party whose own authority to send you cannot demonstrate.
  • You may email contacts you gathered directly through your ordinary ministry, membership, donor, visitor, event registration, volunteer, or other direct relationship activities, subject to applicable law and to each recipient's preferences.
  • You are responsible for determining the message classification, lawful basis, required consent, required disclosures, and opt-out requirements that apply in each recipient's jurisdiction. A membership, ministry, donor, visitor, volunteer, or other direct relationship may support communications where the law permits, but it does not remove any requirement for consent, notice, identification, or opt-out.
  • You must not attempt to work around sending controls, including by creating additional accounts or organizations to spread volume, rotating domains, misrepresenting sender identity, or repeatedly re-importing contacts who have unsubscribed or complained.

What we may do

We may act in our reasonable discretion, including on the basis of unusual increases in volume, elevated bounce or complaint rates, spam trap or blocklist events, recipient complaints, suspected unauthorized use, or a failure to provide the records described above. Where we do, we will choose a proportionate response, which may include review, a temporary pause, rate limits, cancelling a campaign, requiring verification, requiring list cleanup or a corrective plan, or termination.

Email service protection. We may immediately pause, cancel, rate-limit, restrict, or disable your broadcast or other email sending, or any affected sending server, without disabling your access to the rest of the Service, if we reasonably believe your sending may adversely affect deliverability, sender reputation, security, provider compliance, other customers, or recipients. Your donation records, receipts, and tax statements remain available to you. You will promptly provide information and records we reasonably request so we can investigate, and we will restore sending once you have completed the corrective steps we reasonably require.

We may take immediate action without prior notice where we reasonably believe that delay may cause material deliverability, security, legal, fraud, or provider compliance risk.

We maintain suppression lists of recipients who unsubscribe or report a message as spam, and we may continue to honor those suppressions across the Service even if the address is imported again. We may review sending metrics, message content, headers, templates, and information about how a recipient list was assembled, for the purpose of preventing abuse and protecting deliverability. We may share information about abuse with our email delivery providers, mailbox providers, our advisers, and authorities where appropriate.

Intellectual Property

The Service and its original content, features, and functionality are owned by StewardKit and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written consent.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STEWARDKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

Indemnification

You agree to indemnify and hold harmless StewardKit and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Open Source Notices

StewardKit includes open-source software and fonts. Check-in uses Noto Emoji, Copyright 2013 Google LLC, licensed under the SIL Open Font License, Version 1.1. A full list of third-party components is available on request from the address below.
